This privacy statement sets out our practices regarding the collection, use, storage and disclosure of your personal information in compliance with the Privacy Act 2020. The policy relates to the collection of personal information via our website.
In this privacy statement, the terms “we”, “us” and “our” refer to the Trustees of the NOW Trust and the terms “you” and “your” refer to you as a website user.
“Personal information” means any information about an individual that allows an individual to be identified.
- Collection of personal information
In order to provide you with information about our work and provide you with services, we may collect your personal information – including your email address, name, phone number, mailing address and possible donation preferences, including:
- when you complete forms on our website or elsewhere (including the “NOW Trust Interest Form” on the “Support us” webpage)
- in the course of receiving questions, comments or other communications from you
- if you sponsor an OCC, we may collect the donor type and country you reside in for statistical or other purposes to determine eligibility for a pool of OCCs reserved for persons of Niuean descent
We may also collect other personal information that you provide us with, for example, if you choose to update a profile photo to personalise your login experience on our website.
The name of the entity that is collecting your personal information is the NOW Trust, NOW Office, Utuko Junction, Alofi South, Niue Island.
We will usually only collect personal information directly from you. We may also collect personal information from third parties where it is unreasonable or impractical to collect personal information from you directly, where you have authorised collection from such third parties, or from publicly available sources. We may also collect your personal information from third parties where someone gifts an Ocean Conservation Commitment to you and they provide your name and contact details to us for the purpose of the gifting.
If you do not provide us with all or any part of the personal information that we request from you, we may not be able to supply you with services or the information that you are requesting and/or certain features of our services may not be available to you.
- Use of personal information
The personal information we collect will be used to provide services you have authorised or requested. We may also use the personal information we collect to:
- provide you with information on the NOW Trust’s activities and news from time to time;
- respond to any questions or correspondence from you;
- administer the process of sponsoring an OCC, including generating certificates and ensuring that sponsorship thresholds are not exceeded prior to completing the OCC sponsorship process;
- record all OCC sponsorships; and
- verify your identity and assist you in case you forget your password or login details.
- Disclosure of personal information
We may need to disclose your personal information in order to meet the purposes set out above. We will not disclose your personal information except in accordance with this privacy statement and the Privacy Act 2020.
We may disclose your personal information to:
- the NOW Trust project team;
- any third party you have authorised us to share your personal information with, or we have notified you that we may share your personal information with and you have not objected;
- government or law enforcement agencies, where we believe that it is reasonably necessary to assist with the maintenance of the law;
- suppliers of outsourced functions such as our auditors, accountants, lawyers, data storage providers, JotForm who provides us with our template forms on the website, PayPal who assists us with the technology to allow OCC sponsorship money to be paid or the provider of the Interplanetary File System (IPFS) if you choose to share your OCC sponsorship publicly (the IPFS obtains data from the XRPL system in relation to the minted NFTs correlating to your OCC sponsorship); and
- any other agency where required or permitted by law.
If you are based in New Zealand, we will transfer your personal information outside New Zealand to third parties who are located outside New Zealand. We will ensure your personal information will be protected by comparable safeguards to those in New Zealand law. If your personal information will not be protected by comparable safeguards to those in New Zealand law, we will tell you that this is the case, and only transfer your personal information with your consent.
- Email communications
You have the right to unsubscribe from our publications and newsletter at any time by clicking the “unsubscribe” link in any email communication received. Once you have unsubscribed you will be removed from our mailing list as soon as is reasonably practicable.

Our website contains hyperlinks to third party websites. We take no responsibility for the content of such website, or the manner in which those websites collect, store, use, and disclose any personal information you provide. When visiting a third-party website from hyperlinks displayed on our website, we encourage you to review the privacy statements of those websites so that you can understand how the personal information you provide will be collected, stored, used and disclosed.
Our website also hosts content in the form of articles, videos and similar material. The Trustees of the NOW Trust are not responsible for this material, nor do they endorse the accuracy of its content or its continued currency, even though it is included it on our website.

Your personal information is held by the NOW Trust, through it third party service provider, Inmotion Hosting, 555 S Independence Blvd, Virginia Beach, VA 23452, USA. The information collected on, or through, our website is stored on secure servers based in the United States of America.
We will not retain your personal information for any longer than we have a lawful purpose to use it.

Whether your personal information is stored by us locally or with our data storage providers, we take all reasonable steps to ensure that it’s protected against loss, misuse and unauthorised access, use, modification, or disclosure.
Our service providers, such as JotForm and PayPal, also have policies in place to ensure that your personal information is protected against loss, misuse and unauthorised access, use, modification, and disclosure.
